On or about November 1, 2022, the City of Rock Hill will authorize the Housing Authority of the City of Rock Hill to submit a request to the HUD Field Office of South Carolina for the release of Radon Testing and Mitigation Demonstration for Public Housing funds under Section 9(d) of the United States Housing Act of 1937 (1937 Act) (42 U.S.C. 1437g(d)) and the Consolidated Appropriations Act, 2021 (Public Law 116-260, approved December 27, 2020) to undertake a project known as Radon Testing and Mitigation Demonstration for Public Housing for the purpose of conducting testing and mitigation and as-needed mitigation of radon in the public housing units that they manage and where applicable to, support the development of a plan for future testing and mitigation. Funding is estimated at $600,000. The project location is scattered site public housing units in the city of Rock Hill, South Carolina and the Town of Great Falls, South Carolina.

The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at 467 S. Wilson Street, Rock Hill, SC 29730 where the record is available for review and may be examined or copied weekdays 8:00 a.m. to 5:00 p.m.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the Housing Authority of the City of Rock Hill. All comments received by October 31, 2022 will be considered by the City of Rock Hill prior to authorizing submission of a request for release of funds.

ENVIRONMENTAL CERTIFICATION

The City of Rock Hill certifies to HUD/SC Field Office that Corinne Sferrazza in capacity as Community Development Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD/SC Field Office's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Housing Authority of the City of Rock Hill to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD/SC Field Office will accept objections to its release of fund and the City of Rock Hill's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Rock Hill; (b) the City of Rock Hill has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD/SC Field Office at Strom Thurmond Federal Building, 1835 Assembly Street, Columbia, SC 29201-2480. Potential objectors should contact HUD/SC Field Office to verify the actual last day of the objection period.
